Couple Sues Martha Stewart, Alleges Lead in Dishes Poisoned Kids

A lawsuit filed by Sandra and Raymond Dombroski of Pennsylvania claims that Martha Stewart's line of "Everyday" dinnerware contains lead. The couple says that they purchased the dishes from K-Mart in 2001, and used them until December of 2006 before realizing that manufacturing and design defects were allowing lead to leak out of the plates. According to the lawsuit, the allegedly defective dinnerware is responsible for causing their two children, Michael and Matthew, to develop "mental, emotional, and cognitive impairment," as well as learning disabilities and speech problems.

The lawsuit accuses Martha Stewart Living Omnimedia (MSLO) of "negligent, reckless, intentional, and outrageous conduct" and seeks both compensatory and punitive damages. Sears Holdings Corporation, K-Mart's parent company, has also been named as a defendant.

A spokesperson for MSLO told reporters that the company takes consumer product safety "very seriously" but refused to comment on any ongoing litigation.
